Consumer law notice: Nothing in these Terms limits or excludes any rights you have under mandatory consumer protection laws that apply to you (for example, EU/UK consumer law or U.S. state consumer protection statutes). Where these laws grant you non-waivable rights, they prevail over any conflicting term below.

If you are located outside the United States, TEAMM8 LLC provides the Site and sells/ships globally, and mandatory local laws for your country may also apply (see regional notes below).

2. Eligibility & account

• You must be at least 16 years old or the age of majority in your jurisdiction (whichever is higher) to make purchases on the Site. If you are under 18, you must have a parent/guardian’s consent.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• We may refuse service, close accounts, or cancel orders at our discretion where permitted by law.

3. Products, pricing & availability

• Product details, images, sizing, colours and availability are provided in good faith and may change without notice. Colours can appear differently depending on your device.
• Prices are shown in your selected market currency and may vary by region. Where required, we collect sales tax/VAT/GST at checkout based on your shipping address. If taxes/duties cannot be calculated at checkout, you may be responsible for paying them on delivery.
• For EU/UK orders, VAT may be collected at checkout where applicable. For international shipments outside your customs union, import duties and fees may apply.
• We may correct pricing errors and cancel affected orders before dispatch; if we do, you’ll receive a full refund of amounts paid for the cancelled items.

4. Orders & payment

• By placing an order you are offering to purchase products subject to these Terms. Order acceptance occurs when we dispatch the products and send a shipping confirmation.
• We accept the payment methods shown at checkout. You authorise us (or our payment processor) to charge your selected method for the order total, including shipping and taxes/duties where applicable.
• Orders may be cancelled or amended prior to dispatch where operationally possible. Once dispatched, our Returns section applies.

5. Shipping, risk & title

• Estimated delivery windows shown at checkout are estimates only. We aren’t responsible for delays outside our reasonable control (e.g., carrier delays, customs inspections, natural events).
• Risk in the goods passes to you upon delivery to the address you provide (or to the carrier where you arrange your own collection). Title passes when we receive full payment.
• You must provide accurate shipping details. Undeliverable parcels may be returned to us; re-shipping fees may apply.

6. Pre-orders & backorders

For items sold as pre-orders or backorders, the estimated ship date is an estimate only and may change. We’ll ship when stock is available. You can cancel any time before dispatch for a full refund.

7. Returns, exchanges & refunds

Change-of-mind returns (TEAMM8 policy)

• We accept change-of-mind returns of full-price apparel within 30 days of delivery, provided items are unused, unwashed, with tags/hygiene seals intact, and in original packaging.
• Final sale, discounted/clearance, gifts with purchase, and digital downloads are not eligible for change-of-mind returns (unless your local law requires otherwise).
• For hygiene reasons, underwear, swimwear, and socks can only be returned if unworn with hygiene seal intact or if faulty.

Your statutory rights (region-specific highlights)

• EU/UK consumers: You have a 14-day right to withdraw from most online purchases from the day after delivery, with another 14 days to return. This does not apply to sealed goods not suitable for return for health or hygiene reasons once unsealed (e.g., underwear/swimwear) or to customised items. If you exercise your right of withdrawal, we refund the item price and the standard delivery cost; you bear return postage unless we state otherwise.
• U.S. consumers: Your rights under applicable state consumer protection laws remain unaffected. Some states provide specific remedies for defective goods in addition to our policy.
• Other regions (e.g., Canada, LATAM, Middle East): Mandatory consumer rights in your country apply in addition to our policy.

Faulty products

If a product is faulty or not of acceptable quality, you may be entitled to a repair, replacement, or refund under applicable law. Contact hello@teamm8.com with your order number and photos.

Return shipping

Unless required by local law, return shipping costs are your responsibility for change-of-mind returns. Keep your postage receipt and tracking.

How to start a return

Visit our Returns Portal (link in your order confirmation or on our Site) and follow the prompts. Once approved, you’ll receive instructions. Refunds are made to the original payment method (minus shipping where applicable) after inspection.

8. Promotions, bundles & gift with purchase

• Promotions, discount codes, bundles (e.g., “Play Bundles”), loyalty rewards, and referral offers are subject to their specific terms and the following:
• Unless stated otherwise, one code per order, non-transferable, no cash value, and cannot be combined with other offers.
• Minimum spend thresholds are calculated after discounts and before shipping/taxes.
• If you return items from a promotional order, any refund may be reduced to reflect the value of the offer used. Returning below a threshold may forfeit the discount.
• Gift with purchase (GWP): Gifts are subject to availability, may have size variants, and must be returned unused and unopened if your return causes you to fall below the qualifying threshold. If not returned, the retail value of the gift may be deducted from your refund.

9. TEAMM8 Club (loyalty program)

• TEAMM8 Club membership, points, tiers (Bronze/Silver/Gold), and rewards are governed by these Terms and any program-specific rules published on the Site.
• Points accrue from the time you join and have no monetary value, are not transferable, and may expire after 12 months of inactivity. Fraud, abuse, or returns may cause points adjustments or account closure.
• We may change or end the program with reasonable notice, subject to applicable law. Nothing in this section limits your consumer rights.

10. Referral program

If offered, referrals provide stated rewards (e.g., percentage discount) when new customers make a qualifying first purchase via your unique link/code. Self-referrals are prohibited. We may deny rewards for suspected abuse.

11. Gift cards

TEAMM8 digital gift cards are redeemable only on the Site, are not reloadable, and are not redeemable for cash (except as required by law). Treat gift cards like cash; we are not responsible for lost or stolen cards.

12. Wholesale & B2B

Wholesale accounts and orders are subject to separate written terms. Where there is a conflict, the separate wholesale agreement prevails for wholesale purchases.

13. Digital products

• Where we offer digital downloads (e.g., planners/journals), delivery is by download link. All digital items are final sale except where required by law.
• EU/UK consumers: You have a 14-day withdrawal right for digital content not supplied on a tangible medium unless you consent to immediate supply and acknowledge you will lose this right when download/streaming begins.
• You receive a non-exclusive, non-transferable license for personal use only. You may not resell, share, or distribute digital files.

14. User content & reviews

• You may post reviews, photos, or other content where available. You must not post anything unlawful, defamatory, infringing, obscene, misleading, or that contains personal information of others.
• By submitting content, you grant TEAMM8 a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display that content in connection with the Site and our marketing, in any media. You represent you own or have rights to the content you submit.

15. Intellectual property

The Site and its content (including imagery, logos, trademarks, product names, text, graphics, and code) are owned by or licensed to TEAMM8 and are protected by IP laws. You may not copy, modify, or use our IP except as permitted by law or with our prior written consent.

16. Acceptable use

You must not misuse the Site. For example, you must not:

• interfere with or disrupt the Site or our systems;
• use robots/scrapers to extract content without permission;
• attempt to gain unauthorised access to accounts or data; or
• use the Site for unlawful, fraudulent, or harmful purposes.

17. Third-party services & links

The Site may link to or integrate third-party services (e.g., payment providers, social platforms, shipping partners). Those services are subject to their own terms and privacy practices; we are not responsible for them.

18. Privacy & cookies

• Our Privacy Policy explains how we collect, use, and share personal information and your rights. By using the Site, you consent to our data practices consistent with applicable law, including GDPR/UK GDPR for EU/UK users and U.S. state privacy laws (e.g., California CPRA) where applicable.
• We use cookies and similar technologies. In the EU/UK, we obtain consent for non-essential cookies; elsewhere, you can manage preferences via your browser or our cookie tools where available.

19. Warranties, disclaimers & liability

• Except as required by non-waivable consumer law, the Site and products are provided on an “as is” basis without warranties of any kind.
• To the extent permitted by law, we exclude all liability for: (a) indirect or consequential loss; (b) loss of profits, revenue, goodwill, or data; and (c) losses arising from events beyond our reasonable control.
• Where liability cannot be excluded, it is limited to (at our option) resupplying the services or the cost of resupply, or replacing/repairing goods or paying the cost of replacement/repair, as permitted by law.

20. Indemnity

You indemnify TEAMM8 from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site, except to the extent caused by our negligence or breach of law.

21. Governing law & disputes

These Terms are governed by the laws of the State of California, USA. The courts located in California have non-exclusive jurisdiction.

Consumer protection carve-out: If you are a consumer located in the EU/UK or another jurisdiction with mandatory consumer protection rules, you also benefit from those rules, and you may bring proceedings in your local courts as required by law.

Before commencing proceedings, each party will use good-faith efforts to resolve disputes and may agree to mediation (virtual or in the United States) unless prohibited by mandatory law.

22. Changes to the Site or these Terms

We may update the Site and these Terms from time to time. Material changes will be posted on the Site with a new effective date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

23. Suspension & termination

We may suspend or terminate your access to the Site if you breach these Terms, if required by law, or for security or operational reasons. You may stop using the Site at any time. Sections that by their nature should survive termination will survive (e.g., IP, liability, governing law).

24. General

• Entire agreement: These Terms and the documents referenced in them form the entire agreement between you and us about the Site and purchases made through it.
• Severability: If any part of these Terms is invalid, the rest remains in effect.
• Assignment: You may not assign your rights without our consent. We may assign our rights and obligations where permitted by law (e.g., to an affiliate or in a business transfer).
• Notices: We may contact you via email, your account, or notices on the Site.

26. Regional terms (summary)

• EU/UK: 14-day right of withdrawal for most goods (exceptions for unsealed hygiene items and customised goods). VAT may be collected at checkout; otherwise duties/taxes payable on delivery. Non-essential cookies require consent. You may bring claims in local courts.
• United States: Sales tax collected where required by law based on your shipping address. Your state’s consumer protection laws apply in addition to these Terms.
• Canada & Latin America: Import duties/taxes may apply and are your responsibility unless stated otherwise at checkout. Local consumer protections apply as required by law.
• Middle East: Duties/taxes and import restrictions vary by country; check local rules. Local mandatory consumer protections apply where applicable.
